Compliance requirements
The bidder is excluded if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. The bidder must confirm that neither it nor the persons with authority to represent, decide for or control it have been convicted of participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign workers, human trafficking or other listed offences. The bidder must also have no outstanding national tax, fee or environmental charge debt, or tax debt in its country of establishment. If the tender is submitted together with a foreign company, documents confirming the absence of exclusion grounds for that company and its representatives must be provided when requested by the contracting authority or when the information cannot be checked in public registers.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the official tender documents. As compliance requirements, the bidder must confirm that it has reviewed the procurement object and all conditions, has the rights needed to prepare the tender and perform the contract, and that the offered equipment is new, unused, defect-free and complies with the technical requirements. In addition, a bid security of EUR 17,000, a technical description, a duly completed price table, a power of attorney if the signatory is not the legal representative, and, where applicable, documents for a foreign company and joint bidders must be submitted. If subcontractors are used or the bidder relies on another company’s capacities, the relevant authorised persons’ details or confirmations must also be provided.
