Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption and fraud. The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted of the relevant offences within the last five years, or that the exclusion period no longer applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the relevant professional register or in the economic activities register for the activities ‘Design’ and ‘Preparation of traffic management projects’ for the lots to which this requirement applies. In the ESPD, the bidder must confirm the existence of the registration and, if needed, provide evidence of the registration. The compliance conditions require confirmation that the bid complies with the procurement documents and that equivalence has been explained and supporting evidence attached where necessary. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. If subcontractors or suppliers are used in the bid, the bidder must confirm that no more than 10% of the contract value will be performed by subcontractors or suppliers who are citizens, residents or entities established in the Russian Federation, or persons or entities connected to them, as set out in the compliance conditions.
