Compliance requirements
The bidder must confirm that neither it nor its board members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or any other exclusion ground listed in the contract notice and tender documents. If any such ground applies, the bidder may submit evidence of self-cleaning measures where this is allowed. It must also confirm that no subcontractors or suppliers subject to the stated restrictions will be used for performance of the contract and that the offered goods are not subject to international sanctions and do not originate from sanctioned regions.
Qualification criteria and exclusion grounds
The bidder must have carried out, within the last 60 months, at least one works contract under a land improvement system design that fully built or fully reconstructed a regulating network of a land improvement system, including at least 10 culverts with a diameter of at least 1000 mm. The work must have been performed as the main contractor or as a subcontractor carrying out or organising all construction works, and proper performance must be evidenced if requested by the client’s or main contractor’s confirmation. If the bidder relies on the resources of another undertaking, it must also submit that undertaking’s details and consent. The bidder must have a responsible specialist for the execution of the works or a person with equivalent professional qualification; if the person does not hold an Estonian professional or competence certificate, a copy of the licence or professional certificate from the country of establishment, or other proof of the right to perform the relevant work, must be provided. The tenderer must also provide the responsible person’s details in the ESPD. The tender must comply with the procurement documents and conditional tenders are not allowed.
