Compliance requirements
The bidder must confirm that neither it nor its management, representation or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, fraud, or offences related to committing a terrorist act or terrorist activity. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that it will not use a subcontractor in contract performance if that subcontractor would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must have, within the last 60 months, completed as a main contractor at least 1 contract under which at least 1 building construction project with a closed net floor area of at least 220 m2 was carried out. Similar works include accommodation, catering, office, entertainment, education, healthcare and other public buildings, as well as construction, extension or reconstruction works for such buildings performed as a main contractor. If the subject of the work was only part of a building, the required size must be at least 220 m2 for that part. In the ESPD, the bidder must provide the contract object, intended use, closed net floor area, volume of works, contract period and details of the other contracting parties. In addition, the bidder must have a project manager and other qualified persons required for the works in accordance with the qualification requirements described in the ESPD; the exact roles and qualifications must be checked in the tender documents. The bid must comply with the procurement documents and, where necessary, equivalent solutions must be explained and supported by evidence. The bidder must also confirm site inspection where this is a condition for submitting a bid, and provide the required confirmations and powers of attorney regarding joint bids, reliance on another entity's resources and subcontractors.
