Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted in the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking, fraud, commission of a terrorist act, or offences related to terrorism, and that the relevant exclusion grounds do not continue to apply.
The bidder must also confirm that it does not use a subcontractor in the performance of the contract who would have to be replaced under Section 122(7) of the Public Procurement Act. If any exclusion ground exists, the bidder may submit evidence of self-cleaning or restored reliability where this is allowed by the tender documents or by law.
Qualification criteria and exclusion grounds
The bidder must have experience in similar works. In the 60 months before the start of the procurement, the bidder, or the group of joint bidders as a whole, must have properly completed at least one public road construction contract that included asphalt surfacing works in a total amount of at least 9,600 m².
The bidder must provide, on request, a client reference confirming the road repair works on public roads, including the completion date, the quantity of works in square metres, and confirmation that the works were carried out properly. For faster processing, the contracting authority recommends submitting this document together with the tender.
The project manager must have the right to manage road construction works under the laws of the country of residence. If the project manager does not reside in Estonia and does not hold at least a level 6 road engineer professional certificate in the road construction and maintenance specialty, the bidder must submit a copy of the operating licence issued in the country of residence or proof that the project manager is entitled to manage road construction works under the laws of that country. The bidder must enter the project manager’s name and personal identification code in the ESPD.
The tender documents also require the bidder to confirm that the tender complies with all tender document requirements, that any equivalence has been explained and supporting evidence added where needed, and that the price form has been completed in the required structure.
