Compliance requirements
The bidder must confirm that neither the bidder nor the members of its management, administrative or supervisory bodies, nor its proxies or other authorised representatives, have been convicted within the last five years for participation in a criminal organisation, corruption, fraud or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. If requested by the contracting authority, the bidder must also provide the names and personal identification numbers of persons who are not visible in the business register, or confirm that no such persons exist.
Qualification criteria and exclusion grounds
The bidder’s average annual net turnover for the last three completed financial years must be at least EUR 60,000 for the period 01/01/2023–31/12/2025. The bidder provides an initial declaration in the ESPD, and the contracting authority may request an extract from the last three annual accounts or other proof.
To demonstrate technical and professional capacity, the bidder must have properly performed at least one contract for preparing the main design of a public toilet module within the last 60 months, where water supply, sewerage and electrical supply had to be designed. The bidder must provide the contract description, dates of conclusion and performance, contract value and details of the other contracting party. If the information is not available from public registers, the contracting authority may request additional explanations or documents.
The tender must comply with the procurement documents and compliance requirements. The bidder must confirm that the tender meets all requirements, that no conditional tender has been submitted, that the tender price is provided in the required form excluding VAT, and that there are no blank fields or zero or negative unit prices in Annex 2. The bidder must submit the duly completed Annex 2 tender price form and payment schedule. The bidder must also confirm that it has reviewed the requirements for specialists involved in contract performance and that, in addition to the persons named under the selection criteria, the contractor will also involve specialists for the relevant disciplines. If successful, the bidder must provide, if requested after contract award, a list of team members and their professional certificates or other supporting documents.
