Compliance requirements
The bidder and its management body members must not have been finally convicted within the last five years of participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing. Other exclusion grounds listed in the ESPD also apply, including child labour and human trafficking-related grounds, the exact content of which must be checked in the tender documents. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted.
Qualification criteria and exclusion grounds
The bidder must have carried out traffic management device works or road maintenance works worth at least EUR 50,000 excluding VAT during the last three years, and must provide details of at least one such contract, including value, dates and the client. The bidder must have the personnel needed to perform the contract and access to the required equipment and machinery. The bidder must also ensure 24/7 dispatch service for certain services. The successful bidder must appoint one dedicated works manager responsible for service delivery and overall work organisation at the contracting authority’s sites. The tender must comply with all requirements set out in the procurement documents, and the tender price must be submitted in the required form and structure. In the case of a joint tender, a power of attorney for the joint bidders must be submitted; if the tender is signed by a person without signing authority, a power of attorney must be attached.
