Compliance requirements

The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators, or other persons with authority to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activity, money laundering or terrorist financing, or any other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contracting authority may also require confirmations regarding subcontractors and suppliers so that they are not linked to the Russian Federation or subject to sanctions. It must also be confirmed that no subcontractor subject to replacement is engaged.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of its country of establishment, and the contracting authority may require proof of registration. As regards technical and professional capacity, the bidder must have properly performed at least one contract within the 36 months before the publication date of the contract notice, under which at least 150 m³ of contaminated soil was removed. A project manager must be involved in the works, with at least 1 year of experience in contamination remediation works and experience of managing at least 2 similar assignments as the contractor’s project manager. The tender must comply with the procurement documents, and where necessary equivalent solutions must be supported by evidence. In the case of a joint tender, a power of attorney from the joint bidders must be submitted. By submitting the tender, the bidder must also confirm that the tender complies with all conditions set out in the procurement documents.
