Compliance requirements
The bidder must confirm that neither it nor its management or authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering, terrorism-related offences or any other exclusion grounds named in the contract notice and the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The contracting authority may also require confirmation of payment of taxes and social security contributions. The exact exclusion grounds and any remediation conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must submit the completed participation application, the completed price form and the completed technical specification/tender form. The bidder must be the official representative and/or authorised reseller of the offered product and must provide a manufacturer document proving sales rights and technical support rights. The bidder must confirm that the tender complies with the procurement documents, that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that the products are transported and stored according to the manufacturer’s conditions. The products must bear the CE marking and comply with Regulation (EU) 2017/746 or be placed on the market under its transitional provisions; if products still compliant with Directive 98/79/EC are offered, the manufacturer’s commitment to replace them by the end of the transition period must be submitted. In addition, the bidder must provide the manufacturer’s technical data sheets, certificates, safety data sheets, user manuals and storage/preservation conditions.
