Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption and fraud. The bidder, or members of its management, administrative or supervisory body, the authorised signatory, or other persons with power to represent the bidder, must not have been finally convicted of these offences within the last five years if the disqualification still applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is permitted. The machine-readable notice did not include any other precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have sold similar chairs under at least 1 contract within the last 36 months, and the contract value excluding VAT must be at least EUR 8,000. The bidder must provide confirmation and the required details in the standard ESPD form. In addition, the company must be registered in the commercial register of its country of establishment. The bid must include the completed specification, the bidder’s declaration form and, where applicable, the joint bidders’ power of attorney. The bid must comply with all tender document requirements, remain valid for 90 days and include the required technical description. As compliance conditions, the bidder must confirm the REACH candidate substances information, the disassembly and repair instructions for the furniture, a warranty of at least 2 years, and the availability of spare parts or equivalent elements for at least 5 years after delivery. The bidder must also confirm that subcontractors and suppliers linked to the Russian Federation will not be used for more than 10% of the contract value.
