The bidder may be excluded if any of the listed exclusion grounds apply. These include, among others, a breach of a previous contract with Eesti Energia AS or a group company, an outstanding enforceable monetary claim, a breach that led to a contractual penalty or other legal remedies, failure to comply with the partner ethics code or occupational health and safety requirements, convictions for the listed offences, submission of false information or forged documents, withdrawal of the bid after the submission deadline, refusal to sign the contract after the bid was declared successful, and failure to provide information or documents requested by the contracting authority. The bidder must confirm that none of these grounds apply.

The bidder must be registered in the business register or another equivalent register in its country of establishment, if required by that country’s law. For bidders registered in Estonia, the contracting authority checks the data itself; a foreign bidder must submit a copy of a valid registration certificate. As to technical and professional capacity, the bidder must have completed or currently be performing at least two solid fuel contracts and must provide the information on Form I. The bid must be submitted in the structure required by the procurement documents, including the price offer on Form II. The bidder must also confirm that the bid complies with the tender documents and that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
