Compliance requirements
The bidder must not be subject to the mandatory exclusion grounds: conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; conviction for enabling the illegal employment of a foreign national or for violating wage requirements; conviction for illegal use of child labour or human trafficking; and outstanding state tax, fee or environmental charge debts, or tax and social security contribution debts. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or Belarus, and that the materials, equipment and goods used in the works are not produced in or originating from Russia or Belarus. In the case of a joint bid, a duly authorised representative must be appointed and a joint bidder power of attorney must be attached. The bidder must also confirm that no voluntary exclusion grounds apply, such as a material or repeated breach of a previous public contract or the submission of false information about qualification.
Qualification criteria and exclusion grounds
The bidder must have properly performed at least three similar electrical construction contracts within the 60 months preceding the start of the procurement, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. Upon request by the contracting authority, evidence of proper performance must be provided unless the authority can obtain the information from public or its own databases without major expense. The bid must also include the price table, and the bidder must confirm that the bid complies with the procurement documents and that no conditional or additional terms are submitted. The team must include a person with valid switching authorisations who is entered in Elektrilevi’s partner portal before the bid submission deadline; depending on the works, both low-voltage and medium-voltage switching authorisations may be required. There must also be a person responsible for the work operation who is entered in the partner portal before the deadline. In addition, the team must include a lead electrical worker with valid A-competence and/or at least level 6 qualification under the Occupational Qualifications Act, with the relevant proof available at the time of bid submission and entry in the partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included. The machine-readable notice did not include precise requirements; these must be checked in the tender documents.
