Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor other persons authorised to represent it, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing. The bidder must also confirm that, where applicable, measures to restore reliability have been taken. If a ground for exclusion exists, the bidder may submit evidence of self-cleaning where permitted. The exact exclusion grounds and any acceptable evidence must be checked in the tender documents.
Qualification criteria and exclusion grounds
Within the 36 months before the start of the simplified procedure, the bidder must have completed or be performing at least one electrical installation operation and maintenance management contract, or several contracts covering at least 10 different managed objects in total. The bidder must provide a list of those contracts with their value, dates and the other contracting parties. For the entire duration of the contract, the bidder must have access to an operation manager with a valid A- or B-class electrical competence certificate or the professional qualification of Electrical Engineer, level 6. The certificate must include the specialisation required for the work, especially the operation of consumer or building electrical installations. The compliance conditions also require a joint bid power of attorney where applicable, confirmation that the bid complies with the tender documents, declaration of business secrets, submission of the bid price in the required structure, and confirmation of equivalence where relevant.
