Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: participation in a criminal organisation, corruption, fraud, money laundering, terrorism-related offences, enabling the employment of an illegally staying foreign national, or illegal use of child labour. The bidder must also confirm that no optional exclusion grounds apply, such as a material breach of a previous contract or false information about qualification.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, reference numbers. The contracting authority may request evidence of proper performance of those contracts. The tender must comply with the procurement documents and include the required price table. The bidder must have a worker with valid switching authorisations for switching operations in the 0.22–20 kV network; if only low-voltage works are procured, at least low-voltage switching authorisations are sufficient, otherwise both low- and medium-voltage switching authorisations are required. There must also be a person with valid rights designated as responsible for the work operation. The bidder must have a person managing electrical works who has valid A-competence or at least level 6 qualification within the meaning of the Occupational Qualifications Act and the relevant certificate at the time of tender submission. The bidder must also provide the names and contact details of the contract signatory and contact person, and a power of attorney if needed. Materials, equipment and goods used in the works may not be produced in or originate from the Russian Federation or Belarus; the contracting authority may request certificates of origin. The bidder must also confirm that its place of establishment is not in Russia or Belarus.
