Compliance requirements

The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply to it. These cover, among other things, convictions for criminal offences, labour law violations, offences involving child labour or human trafficking, tax debts, and breaches of sanctions. The exact confirmation must be provided in accordance with the tender documents.

Qualification criteria and exclusion grounds

The bidder or its subcontractor must have at least one properly performed contract of a similar scope and complexity to the subject of the tender, completed within the 60 months preceding the start of the procurement. A list of contracts must be submitted, including their value, dates and the other contracting parties. The person responsible for carrying out the works must hold a road engineer professional qualification at least level 6 (excluding initial qualification) with competence in managing construction activities or construction management, or an equivalent or better qualification. A copy of the document proving this person’s qualification and competence must be submitted. If subcontracting is used, the subcontractor’s consent to perform subcontracting must also be provided. The bidder or its subcontractor must have at least one welder with certification compliant with EVS-EN ISO 9606-1, or an equivalent proof. A document proving the qualification and competence must also be submitted for this person. The bid must comply with the tender documents; conditional bids are not allowed. In the case of a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. A completed price form must also be submitted, and the resulting total price must be transferred to the relevant bid form.
