Compliance requirements
The bidder must be excluded if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control the bidder, has a final conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal use of child labour or human trafficking. Exclusion also applies if the bidder has tax, environmental charge or social security contribution arrears in the relevant sense. In addition, the contracting authority may exclude a bidder that has seriously breached a previous contract or has provided false information about qualification or failed to submit required information or documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works are not produced in or originating from Russia or Belarus; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party (including the client representative’s contact details) and, in public procurement cases, the reference numbers, if available. On request, the contracting authority must be provided with evidence that the similar electrical construction contracts were properly performed. The bid must comply with all tender documents and include a price table with all unit price fields completed. Before the bid opening deadline, the team must include an employee with valid switching rights entered in the Elektrilevi partner portal, a person appointed as responsible for the work operation, and a leading electrical works person with valid A-competence or at least level 6 qualification and the relevant certificate. The bidder must also provide the names and contact details of the contract signatory(ies) and the contact person, and a power of attorney if required. If the bidder does not choose the contracting authority’s standard payment term, a 95-calendar-day payment term applies under the factoring programme.
