Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1) of the Public Procurement Act apply, including criminal offences, labour law violations, child labour or human trafficking, tax debts and international sanctions. The bidder must also confirm that it does not breach any residence- or establishment-based participation restriction set by the contracting authority, if such a restriction applies in the tender documents.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register or another equivalent register of its country of establishment, if required by the laws of that country. A foreign bidder must provide confirmation of this; for bidders registered in Estonia, the contracting authority checks the data itself. To prove technical and professional capability, the bidder or the manufacturer it represents must have produced and marketed similar goods for the last three years and must submit a list of the most important contracts for railway rails, turnouts and turnout components performed during the last three financial years, including quantities and customers. The tender must comply with the tender documents, and conditional tenders are not allowed. The bidder must also confirm compliance with the packaging requirements, submit documents proving product conformity (quality certificates, product passports, installation instructions and information on service life and conditions of use), submit at least 10 samples by the tender submission deadline to Malmi 8, Jõhvi city, 41537 Ida-Viru County, and confirm acceptance of the framework agreement without fixed quantities. The first batch must be delivered no later than 21 September 2026, the first quantity is 40,000 units, and the remaining quantity is up to 250,000 units per year. Ordered spare parts must be delivered within 84 calendar days from the written order.
