Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, representatives or persons with powers to represent or control the bidder have been finally convicted within the last 5 years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may provide evidence of self-cleaning measures where permitted. The bidder must also confirm that taxes and social security contributions are paid, or allow the contracting authority to verify this electronically from a database.
Qualification criteria and exclusion grounds
The tender must comply with the procurement documents, the technical specification and the mandatory price form Näidisostukorv_311581. The offered unit prices must include delivery to the buyer’s location and unloading, and they will remain fixed for the entire contract period. If the contracting authority has doubts about product compliance, it may request evidence or documents proving compliance. In a joint tender, a power of attorney for the joint tenderers must be attached. The tender must be unconditional, and the bidder must confirm compliance with all conditions set out in the procurement documents. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas, and that subcontractors or suppliers who are citizens, residents or undertakings established in the Russian Federation, or entities owned or controlled by them, are not involved in more than 10% of the contract value. The bidder’s place of residence or establishment must be in Estonia, another EU Member State, an EEA contracting state or a country that has acceded to the WTO Government Procurement Agreement.
