The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, nor persons with representation rights, have been finally convicted within the last five years for participation in a criminal organisation, money laundering, terrorist financing, child labour or other forms of human trafficking, where such grounds apply. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures to restore reliability. The bidder must have performed at least one small-equipment supply contract similar to the subject of the procurement within the 36 months preceding the start of the procurement, each with a value of at least EUR 4,000 excluding VAT. If a contract is still being performed after the deadline for submitting tenders, qualification may be demonstrated for the part and value that have been delivered to and accepted by the buyer by the start of the procurement. The tender must comply with all conditions set out in the tender documents, and conditional tenders are not allowed. In the case of a joint tender, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bidder must also indicate any trade secrets in the tender, but the tender price and other numerical indicators related to evaluation may not be marked as trade secrets.
