Compliance requirements
The bidder must not be subject to the mandatory exclusion grounds: conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or financing of terrorism; conviction for enabling illegal employment of foreigners or violating the conditions for employing foreigners; conviction for illegal use of child labour or human trafficking; or tax, fee or environmental charge arrears. The contracting authority may also exclude a bidder if it has seriously or repeatedly breached a previous public contract, or if it has provided false information about qualification or failed to submit required documents. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurements, the reference numbers. Upon request by the contracting authority, evidence of proper performance must be provided. In addition, the bidder must have a person in charge of electrical works with a valid A-competence or a qualification corresponding to at least level 6 under the Vocational Education Act, who holds the relevant certificate at the time of submission and has been entered into Elektrilevi’s partner portal before the opening of tenders. The bidder must also have an employee with valid switching rights, a person designated as responsible for work operations, details of the contract signatory and contact person, and the required price table must be submitted. The tender must comply with all tender documents; conditional tenders and tenders with additional conditions are not allowed. The bidder must also confirm the standard payment term option, the trade secret declaration or non-declaration, and that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus and that the materials, equipment and goods used do not originate from those countries.
