Compliance requirements
The bidder must confirm that neither it nor the members of its management body have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm tax and social security payment information and, where necessary, provide information on beneficial owners, especially for the sanctions-related confirmations.
Qualification criteria and exclusion grounds
To make the tender compliant, the bidder must submit all confirmations and documents required in the procurement documents. These include the technical offer, the price form, a power of attorney for the representative if the signatory is not the legal representative, a joint bidders’ power of attorney in the case of a joint tender, and a manufacturer’s authorisation letter, partner status confirmation or other manufacturer-accepted proof showing the right to act as an official reseller. The offered device must be new, the tender must remain valid for at least 1 month from the submission deadline, and the bidder must agree to the contract signing and return conditions. The machine-readable notice did not include precise selection or suitability criteria; these must be checked in the tender documents.
