Compliance requirements
The bidder must confirm that neither it nor the members of its management bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground mentioned in the tender. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have, for the entire contract performance period, a maintenance engineer or maintenance technician who has received manufacturer training for installing, commissioning, maintaining and repairing the offered equipment. A copy of the certificate confirming that training must be submitted with the tender. The bidder must have authorisation to sell the offered equipment and must provide a document from the manufacturer or authorised supplier. The offered Class II biosafety cabinet with integrated waste management system must bear the CE mark and comply with EN 12469. The tender must include the technical datasheet and user manual in Estonian or English, a maintenance plan, maintenance instructions, electrical safety test instructions and a description of the procedures to be followed during maintenance for the entire contract period. The tender must comply with all technical requirements set out in the procurement documents, and conditional tenders are not allowed. In the case of a joint tender, a power of attorney and a statement on joint and several liability must be submitted. The bidder must also confirm that the goods offered are not subject to international sanctions and do not originate from sanctioned regions, and that subcontractors or suppliers representing more than 10% of the contract value are not Russian nationals, residents or entities established in the Russian Federation, or persons controlled by them.
