Compliance requirements
The bidder must confirm that neither it nor the members of its management, representation or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The machine-readable notice did not set out all exclusion grounds in full; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bid must be digitally signed by a person with the bidder’s right of representation. If it is signed by another person, a power of attorney on Form I of Annex 4 must be attached. In the case of a joint bid, an authorised representative must be appointed and the joint bidders’ power of attorney and joint and several liability confirmation must be submitted on Form II of Annex 4. The bidder must confirm that the bid complies with the tender documents, that any equivalence has been explained and supporting evidence attached where necessary, and that environmental requirements will be met during service delivery. The bid price must be submitted in Annex 5, the price quotation table, as unit prices excluding VAT to three decimal places, and the prices must include all costs related to the service. The machine-readable notice did not include precise qualification or suitability criteria; they must be checked in the tender documents.
