The bidder and its representatives must not be subject to criminal-law exclusion grounds, including participation in a criminal organisation, corruption, fraud and the other grounds listed in the ESPD. If any exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that it will not use subcontractors or suppliers representing more than 10% of the contract value who are linked to the Russian Federation in the manner described in the regulation, and that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.

The bidder must submit the bid in the structure required by the tender documents and complete the technical specification form properly. The offered device and consumables must comply with the requirements set out in document “Annex 1. Technical specification”. The bid must also include the details of the person signing the contract and the contract contact person, and, where applicable, a power of attorney if the contract is signed by an authorised representative. If an equivalent solution is offered, the bidder must explain it and provide evidence of equivalence. The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents.
