Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply, including convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign workers, child labour or trafficking, or tax offences. The bidder must also have no tax, duty or environmental charge arrears, and no tax or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder on optional grounds, for example for breaches of environmental, social or labour law, bankruptcy or liquidation, serious professional misconduct, anti-competitive agreements, conflicts of interest, previous material contract breaches, false statements, or tax offences. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that it does not use subcontractors or suppliers with prohibited Russian links for more than 10% of the contract value. In addition, it must confirm that the offered goods are not the object of international sanctions and do not originate from sanctioned areas.
Qualification criteria and exclusion grounds
During the last three completed financial years, the bidder must have had net turnover of at least EUR 500,000 in at least one year. An extract from the reports for the last three completed financial years must be submitted showing the bidder’s net turnover; for an Estonian legal entity, separate submission may not be required if the data are publicly available to the contracting authority from a register. If the financial year does not coincide with the calendar year, the turnover requirement applies to the last three completed financial years, and at least six months must have passed since the end of the last completed financial year by the deadline for submitting tenders. The bidder must operate as an electricity seller and must have filed the relevant economic activity notice in the business register; if the bidder is not established in Estonia, it must provide a certificate from the competent authority of its country of establishment confirming the registration or licence for that activity. The bidder must also have a trading account in the Estonian system operator’s guarantees of origin register for at least the 12 months preceding the start of the procurement. The bidder must provide the name, job title and contact details of the person signing the contract, and, where necessary, a power of attorney; it must also name the contact person for contract performance matters. The price form, Form 1, must be submitted and completed in full in euros excluding VAT. The bidder must confirm that it agrees to reduce the delivery volume if needed in accordance with the instructions. The machine-readable notice did not include precise compliance requirements; these must be checked in the tender documents.
