Compliance requirements

The bidder must confirm that neither it nor the members of its management, supervisory or control bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour offences or human trafficking offences. The bidder must also confirm that no other exclusion grounds listed in the tender documents and in the Public Procurement Act apply, including unpaid taxes and social security contributions and other statutory prohibitions. If an exclusion ground exists, the bidder may submit evidence of self-cleaning where this is permitted by the tender rules and applicable law.

Qualification criteria and exclusion grounds

The machine-readable notice and the selected documents do not contain precise qualification or suitability requirements beyond the bidder confirmations and document submissions listed in the tender documents. The bidder must confirm that the bid complies with the tender documents, submit the completed participation declaration, the completed technical description bid form, technical information material, product packaging labels, and for medical devices also the instructions for use, the manufacturer’s Declaration of Conformity and, where applicable, the EC Certificate. The bid must follow the required price form structure and include the total price for the lot without VAT. If the bid is a joint bid, a power of attorney for the joint bidders must be attached. The bidder must also confirm equivalence where relevant and provide evidence of equivalence if needed. The tender documents also include a climate and environmental impact reduction objective that can give 2 points if the bidder has a publicly accessible URL showing such a goal.
