Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds listed in Section 95(1) of the Public Procurement Act apply to it. These include, among other things, convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling illegal employment of a foreign national; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears; and conflicts with sanctions. The bidder confirms the absence of exclusion grounds by submitting Form III. The contracting authority may also exclude a bidder that has previously materially breached a contract or submitted false information or failed to provide required documents.
Qualification criteria and exclusion grounds
The bidder must submit the completed Form III declaration of participation in public procurement, complete the price form in Annex 2 separately for each lot, and confirm that the tender complies with the procurement documents and, where necessary, that equivalence has been explained and supporting evidence has been attached. The tender price must be given as a single figure, include all costs necessary for performance of the contract, and must not be negative or zero. Only bidders whose place of residence or establishment is in Estonia, another EU Member State, an EEA Agreement State, or a country that has acceded to the WTO Government Procurement Agreement may participate. If the bid is joint, a power of attorney for the joint bidders must be attached. For each competition area, there must be a separate technical expert with at least 3 years of work experience as a teacher or vocational teacher in the relevant field within the last 5 years, and Form I CVs must be submitted as proof. The bidder must also submit Form II, the team confirmation. If the competition is not held in the contracting authority’s premises, a description of the alternative venue must be provided, including the address, room size and technical conditions. The machine-readable notice did not include precise qualification or compliance requirements; these must be checked in the tender documents.
