Compliance requirements

The tender documents include the standard exclusion grounds from the Estonian Public Procurement Act, especially convictions for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder or its management/representation persons must not be subject to these exclusion grounds, unless self-cleaning is allowed and properly demonstrated. The documents also require confirmation that no subcontractor subject to mandatory replacement is used, and that the bidder does not engage certain Russian subcontractors or suppliers above 10% of the contract value.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the start of the procurement, completed at least one relevant works contract as a main contractor or as a subcontractor organising all works: either fully built or fully reconstructed at least 30 km of drainage network ditches, or fully renewed or maintained at least 60 km of drainage network ditches, or built at least 30 earth dams in bog or mire water regime restoration works. If the bidder relies on another company’s resources, the other company’s details and consent must also be provided. For compliance, the bidder must submit the fully completed price quotation form as an Excel file. In a joint tender, a power of attorney for the joint bidders must be attached. The bidder must also confirm compliance with environmental requirements, unconditional compliance with the tender documents, and equivalence evidence where equivalent solutions are offered.
