Compliance requirements
The bidder must confirm that neither it nor the members of its management, representation or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, the use of child labour or other forms of human trafficking, the commission of a terrorist act or offences related to terrorist activity, or any other exclusion grounds set out in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The exact exclusion grounds and any remediation conditions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bid must comply with all conditions set out in the procurement documents. Conditional, partial and alternative bids are not allowed. Before submitting the bid, the bidder must inspect the site in person and sign the site inspection sheet in the presence of the contracting authority’s representative; otherwise the contracting authority may reject the bid. The bid price must be submitted according to the prescribed Form 4 structure, and unit prices must include all costs related to work, materials, transport, equipment, labour, permits, approvals and document preparation. The bidder must be able to justify how the unit prices were formed, and after submission the data may not be changed except to correct an obvious calculation error or an obvious inaccuracy that can be clarified.
