Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1)–(3) and (5) of the Public Procurement Act apply, that it is not bankrupt or in liquidation, and that it has no tax or social security contribution debts. The bidder must also confirm that its employees’ average salary during the reference period was above 70% of the average salary in the relevant sector and that it is not a related party to the contracting authority’s technical consultant. In a joint tender, the exclusion grounds are checked for each joint bidder. If the exact exclusion grounds or evidence need to be checked, they must be reviewed in the tender documents.

Qualification criteria and exclusion grounds

The bidder must be registered in the construction activity area or, if foreign, provide an equivalent proof. For electrical works, the bidder must also have the relevant electrical works registration or an equivalent proof. The net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. The bidder must be able to provide a performance guarantee equal to 5% of the contract value by the contract signing date at the latest, or within 10 calendar days after signing; the guarantee must remain valid throughout the construction period. As an equivalent reference, the bidder must show at least one similar construction project completed within the last 60 months with a value of at least half of the estimated contract value excluding VAT, involving the erection, extension or full reconstruction of a building as the main contractor and including load-bearing and external envelope works, mechanical ventilation with heat recovery, and construction or reconstruction of a new heating system. The team must include a project manager, site manager, HVAC specialist, water supply and sewerage specialist, and a competent person for electrical works; names and professional certificate numbers must be provided. A quality management system compliant with EVS-EN ISO 9001 and an environmental management system compliant with EVS-EN ISO 14001, or equivalent evidence, are also required. The tender must be submitted as compliant with the procurement documents; conditional tenders are not allowed. In a joint tender, a power of attorney must be attached, and if the tender is submitted by an authorised representative, a power of attorney proving representation rights must be attached.
