Compliance requirements

The contracting authority will exclude a bidder if a ground for exclusion under Section 95(1) of the Public Procurement Act applies. The contracting authority may also exclude a bidder if a ground under Section 95(4) applies. When submitting the bid, the bidder must confirm that no exclusion grounds apply. Before signing the contract, the contracting authority will verify the absence of the Section 95(1) grounds on the basis of evidence.

Qualification criteria and exclusion grounds

The bidder, including a joint bidder, must hold an operating licence for outpatient cardiology services at the place of performance on the day the bid is submitted, and must provide the licence number and confirm that the service will be provided in the premises on which the licence was issued. The bidder’s 2025 net turnover from healthcare services must be at least EUR 191,727; the required turnover is calculated per one full-time outpatient doctor and increases proportionally with the number and workload of doctors included in the bid. The bidder must have provided outpatient cardiology services at least 50 times during the 12 months preceding the date on which the contract notice decision was made, or must be ready to provide e-consultations where this is required by law for the specialty concerned. In addition, the place of performance must have working ECG equipment, devices for 24/7 ECG monitoring (Holter) and daily blood pressure monitoring, and the serial numbers of the devices must be provided together with proof of acquisition and a photo showing the device’s serial number. The bid must include the completed bid form, doctors’ confirmation, healthcare institution confirmation and any other required documents. In the case of a joint bid, an authorised representative must be appointed and a joint-bidder power of attorney must be attached. If the bid contains trade secrets, they must be identified and justified; the bid price and other numerical indicators used for evaluation may not be marked as trade secrets. The bidder must also confirm compliance with the EU Council sanctions requirements, including that subcontractors and suppliers subject to Russian-related sanctions and accounting for more than 10% of the contract value are not used, and that the offered goods are not the object of international sanctions and do not originate from sanctioned territories.
