Compliance requirements
The contracting authority will exclude a bidder if a mandatory exclusion ground under Section 95(1) of the Public Procurement Act applies. The contracting authority may also exclude a bidder if a ground under Section 95(4) applies. When submitting the bid, the bidder must confirm that no exclusion grounds apply. Before signing the contract, the contracting authority will verify the absence of the Section 95(1) grounds on the basis of evidence.
Qualification criteria and exclusion grounds
The bidder, including a joint bidder, must hold a valid operating licence at the place of service delivery on the date of submission for outpatient orthopaedic services. If the bidder also wants to provide orthopaedic day surgery services, it must also hold the relevant licence for day surgery and anaesthesiology day surgery services. If the bidder wants to provide inpatient orthopaedic services, including endoprosthesis operations, it must hold a licence for orthopaedic services and anaesthesiology services, and the licence must state that the bidder is a special hospital or a local hospital.
The bidder’s 2025 healthcare turnover must be at least EUR 97,941 per physician providing outpatient full-time consultations, and this increases proportionally with the number and workload of physicians offered. If the bidder also wants to provide orthopaedic day surgery services, the 2025 turnover must be at least EUR 58,363 in addition to the previous requirement. If the bidder also wants to provide inpatient orthopaedic services other than endoprosthesis operations, the 2025 turnover must be at least EUR 803,186 in addition to the previous requirements. If the bidder also wants to perform endoprosthesis operations, the 2025 turnover must be at least EUR 487,372 in addition to the previous requirements.
The bidder must have provided at least 50 outpatient orthopaedic services during the 12 months preceding the date of the decision to launch the procurement. If the bidder also wants to provide orthopaedic day surgery services, it must have provided at least 12 such services during the same period. If the bidder also wants to provide inpatient orthopaedic services other than endoprosthesis operations, it must have provided at least 12 such services. If the bidder wants to perform endoprosthesis operations, it must have performed at least 12 such operations. For paid services, copies of discharge summaries with the patient’s personal data masked must be submitted.
The bidder must also confirm e-consultation experience or readiness where this is required by law for the relevant specialty. If the bidder has provided e-consultations during the 12 calendar months preceding the calendar month of the decision to announce the procurement, or is ready to provide them through the health information system by the deadline, this must be confirmed.
The bid must include the completed bid form, the physicians’ confirmation, the healthcare institution’s confirmation and any other documents required by the bid form. In the case of a joint bid, a power of attorney for the joint bidders must be included. The bidder may also submit an optional request to provide additional services.
