Compliance requirements
The bidder must confirm that none of the exclusion grounds set out in Section 95(1) of the Public Procurement Act apply to it. The contracting authority will verify these grounds before contract award on the basis of evidence. It must also confirm that none of the grounds referred to in Section 95(4) apply, although the contracting authority has discretion in relation to those grounds. The machine-readable notice did not include any more precise exclusion grounds; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder, including a joint bidder, must hold, on the date of submission of the tender, an operating licence at the place where the service is to be provided for outpatient obstetrics and gynaecology services, outpatient gynaecology services or artificial insemination services, and for the handling of cells, tissues and organs (gametes and embryos). The tender must state the licence number or numbers and confirm that the service will be provided in the premises on which the licence was issued. The bidder’s 2025 net turnover from healthcare services must be at least EUR 45,051; this requirement increases proportionally with the number and workload of doctors included in the tender. The bidder must have provided outpatient infertility treatment services at least 50 times during the 12 months preceding the decision to announce the procurement, and if the services were provided on a paid basis, copies of the discharge summaries with the patient’s personal data masked must be attached. The tender must include the completed tender form, doctors’ confirmation, healthcare institution confirmation and any other documents required in the tender form. In the case of a joint tender, an authorised representative must be appointed and a joint-bidders power of attorney must be attached. Sanctions-related confirmations and, where applicable, a trade secret explanation must also be provided. The machine-readable notice did not include any more precise qualification or compliance requirements; they must be checked in the official tender documents.
