Compliance requirements

The bidder must confirm that none of the exclusion grounds set out in Section 95(1) of the Public Procurement Act apply to it. The contracting authority may also exclude a bidder if a ground under Section 95(4) applies. Before the contract is signed, the absence of the Section 95(1) grounds is checked on the basis of evidence. A confirmation of the absence of exclusion grounds must be submitted with the tender.

Qualification criteria and exclusion grounds

The bidder must have a valid operating licence at the place of service provision on the date the tender is submitted for outpatient general surgery services. If the bidder also wants to provide day surgery services in general surgery, it must also hold a licence for day surgery and anaesthesiology services. The 2025 net turnover from healthcare services must be at least EUR 96,789 per doctor providing outpatient full-time consultations; the requirement increases proportionally with the number of doctors and workload stated in the tender. If day surgery services in general surgery are also offered, an additional net turnover requirement of EUR 27,353 applies. The bidder must have provided outpatient general surgery services at least 50 times during the 12 months preceding the date of the decision to launch the procurement. If day surgery services in general surgery are also offered, they must have been provided at least 12 times. For paid day surgery services, copies of the epikrisis documents with the patient's personal data masked must be attached. The bidder must confirm that it has the required experience or readiness to provide e-consultations, where this is required for the specialty. In addition, the completed tender form, doctors' confirmation, healthcare institution confirmation and any other documents required by the tender form must be submitted. In the case of a joint tender, a power of attorney for the joint bidders must be attached.
