Connection of the Viira Road development area to the electricity network (LC5177)

The contracting authority will exclude a bidder if any mandatory exclusion ground applies to the bidder or to a person representing or controlling it, including convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement, money laundering or terrorist financing; offences related to illegal employment of foreign nationals or breach of conditions for employing foreigners in Estonia, including payment of wages below the statutory minimum; offences related to illegal use of child labour or human trafficking; or outstanding tax, duty or environmental charge debts, or tax or social security contribution debts under the law of the bidder’s country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of an earlier public contract, or if the bidder has provided false information about compliance with qualification requirements or failed to submit required additional documents.

The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, and at least one of them must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting party’s details, including the client representative’s contact information, telephone number and email address, and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without significant cost. The bid must be unconditional and must include the price table in the required form. The team must include a person with switching rights for 0.22–20 kV electrical network switching tasks, who is entered in Elektrilevi’s partner portal before the deadline for submission of tenders. The bidder must also have a person responsible for the work operation, entered in the partner portal before the deadline, and a lead electrical works person with valid A-competence and/or at least level 6 qualification under the Vocational Education Institutions Act, with the relevant proof available at the time of submission and entered in the partner portal before the deadline. The bidder must provide the names, job titles and contact details of the contract signatory or signatories and the contact person for contract performance matters; if the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must confirm acceptance of the standard payment term or, if participating in the contracting authority’s factoring programme, the 95-calendar-day payment term. The bidder must also confirm that the bid complies with the tender documents and that the bidder has no business secrets to declare, or must describe them briefly and justify the designation.
