Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, nor persons with power of representation, decision-making or control, have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences linked to terrorist activities, money laundering or terrorist financing, child labour or other forms of human trafficking. If any exclusion ground applies, details of the conviction and, where relevant, a description of self-cleaning measures must be provided. The machine-readable notice did not include any other precise exclusion grounds; these must be checked in the tender documents.
Qualification criteria and exclusion grounds
At the time the tender is submitted, the bidder must hold a valid community transport operating licence within the meaning of Section 39(1) of the Public Transport Act. The bidder must confirm the existence of the licence in the ESPD and state the licence number; the contracting authority will verify it in the public view of the Register of Economic Activities. Under the compliance requirements, a joint bid must include a power of attorney from the joint bidders. The bidder must also confirm that the tender complies with all tender document requirements and submit the tender price in the required structure.
