Compliance requirements
The bidder must be excluded if any statutory exclusion ground applies to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the bidder: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, offences related to illegal employment of a foreign national, unlawful use of child labour or human trafficking, tax debt, or a sanctions breach. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus. The bidder must confirm that none of these grounds apply.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment if required by that country’s law, and an Estonian bidder does not need to submit a register extract if the information is publicly available. The financial capacity requirement is that the bidder’s total annual net turnover for each of the last three completed financial years must be at least EUR 210,000; for Estonian bidders the contracting authority checks turnover from public databases, while other bidders must provide the relevant extract or proof. If the bidder has been operating for less than three years, the requirement is assessed only for the period of existence. Where necessary, the bidder may rely on the resources of another undertaking, but a declaration signed by both parties must be submitted. For technical and professional ability, the bidder or its subcontractor must have performed at least one similar contract in the last 36 months before the start of the procurement, covering outdoor cleaning services such as street cleaning, street sweeping, car park cleaning, snow removal, ice removal, waste-related services, or planting and maintenance of green areas. A list of contracts must be submitted with the contract name, short description, performance period, and the other contracting party. The bid must also confirm compliance with the tender documents, that the bid price is submitted in the required table structure, that equivalence is explained where needed, and that professional liability insurance of at least EUR 30,000 and a list of equipment used for maintenance work are provided.
