Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement/complicity/attempt, money laundering or terrorist financing; no convictions for enabling illegal employment of a foreign national staying without legal basis or for violating the conditions of foreign nationals’ employment in Estonia, including paying less than the statutory wage; no convictions for illegal use of child labour or human trafficking; and no tax, fee, environmental charge, social security or similar arrears under the law of the bidder’s country of establishment. The bidder must also confirm that none of the voluntary exclusion grounds apply, namely serious or persistent breach of a previous public contract that led to termination, price reduction, damages or contractual penalty, or submission of false information or failure to submit required qualification data or additional documents. The notice also restricts participation by bidders established in Russia or Belarus.
Qualification criteria and exclusion grounds
The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, at least one of them worth at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts with the performance period, details of the other contracting party (including the client representative’s contact details, phone number and email address) and, in public procurement cases, the reference numbers. On request, the bidder must provide evidence of proper performance, unless the contracting authority can obtain the information from public or its own databases without major cost. The bid must include a price table. The bidder’s team must include a person with valid switching authorisations, a person designated as responsible for the work operation, and a leading electrical works person with valid A-competence or a qualification corresponding to at least level 6 under the Vocational Qualifications Act, together with the relevant proof, and all of them must be entered in Elektrilevi’s partner portal before the bid deadline. The bid must also identify the contract signatory and the contact person for contract performance matters; if the signing authority does not arise from the articles of association, a power of attorney must be included. In the case of a joint bid, a joint bidders’ power of attorney must be attached. The machine-readable notice did not provide any further precise qualification or compliance requirements; the remaining requirements must be checked in the tender documents.
