Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that no insolvency or liquidation proceedings have been opened against it, and that its business has not been suspended. The bidder must also confirm that it has no tax debt or social security contribution debt, that the average wage of its employees was above 70% of the average wage in the relevant sector during the reference period, and that it is not a related person to the beneficiary’s technical consultant. In a joint bid, the exclusion grounds are checked for each joint bidder. The detailed verification conditions are set out in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have submitted the relevant activity notice in the Register of Economic Activities for construction, covering general building works, indoor climate systems, and building-internal or associated water supply or sewerage systems. For electrical works, an activity notice for electrical works covering the construction of electrical installations must also have been submitted. The registration requirement does not apply to foreign bidders, but they must provide an equivalent proof of competence if applicable.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value; the exact amount must be entered to the nearest euro. The bidder must accept the condition that, by the contract signing date at the latest or within 10 calendar days after signing, it must provide a performance security amounting to 5% of the contract value for the entire construction period. Joint bidders may provide the security jointly.
Within the last 60 months, the bidder must have carried out at least one comparable construction project with a value of at least half of the estimated contract value excluding VAT. A comparable project must have involved the construction, extension or full-scale reconstruction of a building as the main contractor and must have included at least the construction or reconstruction of load-bearing structures and external envelope elements, the construction or reconstruction of a heat-recovery ventilation system, and the construction or reconstruction of a new heating system. For the project, the bidder must provide the name, building details, time, value, and proof by means of a use notice, occupancy permit, or handover-acceptance certificate.
The team must include a project manager with at least a level 6 construction engineer qualification or a level 6 construction manager qualification; a site manager with at least a level 5 construction site supervisor qualification; a ventilation and heating systems specialist with the relevant level 6 qualification or a construction manager qualification in indoor climate systems; a water supply and sewerage systems specialist with the relevant level 6 qualification or construction manager qualification; and, for electrical works, a person holding a class B competence certificate or a level 6 electrical engineer qualification. All relevant persons, or persons with equivalent competence, must be involved in carrying out the works. Their names and certificate numbers must be provided.
