Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in Section 95(1)(1–3 and 5) of the Public Procurement Act apply, that it is not bankrupt or in liquidation, that its business activities are not suspended, and that it has no tax debt or social security contribution debt. The bidder must also confirm that the average wage of its employees during the reference period was above 70% of the average wage for the same period in the relevant sector, and that it is not a related party to the contracting authority’s technical consultant. In a joint bid, the exclusion grounds are checked separately for each joint bidder.
Qualification criteria and exclusion grounds
The bidder must have a registration for construction activities under the activity area ‘Construction’ covering general construction, indoor climate systems, and internal or adjacent water supply or sewerage systems. For electrical works, the bidder must also have a registration under the activity area ‘Electrical works’ for the construction, including installation, of electrical installations; a foreign bidder may prove equivalent competence with an equivalent certificate.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, turnover values may not be aggregated to meet this requirement; it is sufficient if at least one joint bidder meets it on its own.
The bidder must provide details of at least one equivalent construction project carried out within the last 60 months as the main contractor, involving the erection, extension or full reconstruction of a building and including at least construction or reconstruction of the building’s load-bearing and external envelope structures, construction or reconstruction of a heat-recovery mechanical ventilation system, and construction or reconstruction of a heating system. Completion must be evidenced by a handover-acceptance certificate or by the number of the occupancy notice or occupancy permit in the building register.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and, when electrical works are performed, a person with the relevant competence. For each role, the bidder must provide the person’s name and the number of the professional or competence certificate. The project manager must have at least a level 6 construction engineer qualification or a level 6 construction manager qualification; the site manager must have at least a level 5 construction foreman qualification; the ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification or a level 6 construction manager qualification for indoor climate systems; the water supply and sewerage systems specialist must have at least the relevant level 6 engineering qualification or a level 6 construction manager qualification; and the person performing electrical works must have at least a B-class competence certificate or a level 6 electrical engineer qualification for consumer electrical installations. Equivalent competence is accepted for foreign bidders.
The bidder must confirm in the bid that it agrees to provide a performance security amounting to 5% of the contract value by the contract signing date at the latest or within 10 calendar days after signing. A corresponding sum deposited to the contracting authority’s or a notary’s account is also acceptable, provided the contracting authority remains the beneficiary throughout the construction period. The bid must be submitted on the form required in the tender documents, and conditional bids are not allowed. If a joint bid is used or an authorised representative signs the bid, the relevant power of attorney must be attached. If equivalence is relied upon or team members who are not the bidder’s employees are used, the relevant evidence or confirmations must be provided. The machine-readable notice did not include precise quality management and environmental management requirements; these must be checked in the tender documents.
