Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators or other persons authorised to represent it have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing, or child labour or other forms of trafficking in human beings. If any of these exclusion grounds apply, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm compliance with tax payment obligations in its country of establishment and, where applicable, in the contracting authority’s Member State.
Qualification criteria and exclusion grounds
The bidder must demonstrate technical and professional ability by providing at least two contracts for skate park design similar to the subject of the tender, completed within the 36 months preceding the start of the procurement. The evidence must include at least the description of the work, value, dates and the other contracting party. A similar reference is a skate park design that allowed use by users of different ages and skill levels and included, for example, lighting, stormwater and surface water drainage or infiltration, accessibility requirements and climate-resilient solutions. Under the compliance requirements, a joint bid must include a power of attorney from the joint bidders, and the bid price must be submitted in the required structure. Business secrets may not include the bid price or other numerical indicators used for award criteria.
