Compliance requirements
The bidder must confirm the usual exclusion grounds, including that neither the bidder nor members of its management body have been finally convicted within the last five years for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour or other forms of human trafficking. It must also confirm that no other exclusion grounds listed in the ESPD apply, or that any available self-cleaning measures have been taken and proven. For subcontractors, sanctions-related restrictions apply during contract performance to persons linked to the Russian Federation.
Qualification criteria and exclusion grounds
The bidder’s average net turnover for the last three financial years must be at least EUR 500,000 in each year for the period 01/01/2023–31/12/2025. Within the 36 months before the start of the procurement, the bidder must have completed road surfacing maintenance contracts covering at least 10,000 m2 in total, involving partial or full renewal of the wearing course by asphalting. A short description of those contracts must be provided, including the scope of work, performance period and client contact details, and the bidder must submit evidence of proper performance if requested by the contracting authority. The tender must comply with the procurement documents, conditional tenders are not allowed, the price form in Annex 2 must be completed in the required format, and the tender price and unit prices must include all costs. If the bid is submitted by a joint venture, a power of attorney from the joint bidders must be attached. If subcontractors or suppliers are used, sanctions restrictions must be observed and the bidder must confirm that persons or entities prohibited under the sanctions rules will not account for more than 10% of the contract value.
