Compliance requirements
The bidder must confirm that neither it nor the members of its management, administrative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where this is permitted. The bidder must also confirm information related to the payment of taxes and social security contributions if requested by the contracting authority. The machine-readable notice did not include precise exclusion grounds; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must hold a wholesale licence for medicinal products; the contracting authority will verify this in the licence register. The tender must be submitted in the form required by the procurement documents, and the bidder must confirm that the tender complies with all requirements, including equivalence requirements where applicable. A completed tender submission form must be provided. The compliance conditions also include a sanctions requirement: the bidder confirms that it will not use subcontractors or suppliers for more than 10% of the contract value if they are citizens or residents of the Russian Federation, entities established in Russia, entities more than 50% owned by such persons or entities, or representatives of or persons acting under the instructions of such persons or entities. In a joint tender, a power of attorney from the joint bidders must be attached.
