Compliance requirements
The bidder must confirm that neither it nor its management or authorised representatives have been convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences or offences related to terrorist activities, money laundering or terrorist financing, child labour or other forms of trafficking in human beings, or any other exclusion grounds listed in the tender documents. If an exclusion ground applies, evidence of self-cleaning measures may need to be submitted. For subcontractors, first-tier subcontractors are checked during contract performance.
Qualification criteria and exclusion grounds
The bidder’s team must include a construction manager, level 6, specialising in general construction, or a competent person with a higher-level professional qualification. The bidder must ensure that the team and competencies needed for the construction works are available throughout the contract period. The ESPD must include the responsible person’s name, qualification and professional certificate number. The contracting authority may request a copy of the professional certificate, proof of education and the responsible person’s consent to participate in contract performance. If the bidder relies on the resources of another company, an ESPD must also be submitted for that entity. The bid must comply with the tender documents, and conditional bids are not allowed. The bid price must be submitted in the required structure and in a separate price schedule.
