Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurists or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, money laundering, terrorist financing, child labour or other forms of human trafficking. If such a ground exists, the bidder may submit evidence of self-cleaning, where permitted. In addition, the bidder must confirm that it will not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must prove prior experience: at least one public-space construction contract completed within the 60 months preceding the start of the procurement procedure. Public space means squares and other public areas; comparable experience also includes construction of public sports and leisure facilities, roads or streets in densely populated areas. The work must have been carried out properly and in accordance with good practice. The bidder must list the relevant contracts in the ESPD, together with information on the construction site, dates and the other contracting parties. The bid must comply with the procurement documents and conditional bids are not allowed. The bid price must be submitted according to the required structure, and in the case of a joint bid a power of attorney from the joint bidders must be attached. The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the tender documents.
