Compliance requirements
The bidder must not be subject to the mandatory exclusion grounds: conviction for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or terrorist financing; conviction for enabling illegal employment or violating the conditions for the employment of a foreign national; conviction for illegal use of child labour or trafficking in human beings; or outstanding tax, fee or environmental charge debts. The contracting authority may also exclude a bidder that has seriously breached a previous public contract or has submitted false information about qualification or failed to submit the required documents. The bidder must confirm that none of these grounds apply. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus, and the materials, equipment and goods used in the works must not be produced in or originate from Russia or Belarus; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly completed at least three contracts for electrical construction works similar to the subject of the contract, at least one of which must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting parties (including the client representative’s contact details, such as telephone number and email address) and, in public procurement cases, the reference numbers, if available. Upon request, the contracting authority must be provided with evidence of proper performance of the similar electrical construction contracts, unless the authority can obtain the information from public or its own databases without significant cost. The tender must comply with the procurement documents and include a price table with all unit prices completed. The bidder must have a person with valid switching authorisations for work in the 0.22–20 kV electricity network; if only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching authorisations are sufficient, otherwise both low-voltage and medium-voltage switching authorisations are required. The bidder must also have a person designated as responsible for the work operation. In addition, the bidder must have an electrical works manager with valid A-level competence or at least level 6 qualification within the meaning of the Occupational Qualifications Act, together with the relevant proof at the time of submission. The name(s), job title(s) and contact details of the contract signatory(ies) and the contact person for contract performance must be provided, and a power of attorney must be included where necessary. The bidder must confirm acceptance of the tender documents, submit the required price table and disclose trade secrets only within the permitted scope.
