Compliance requirements
Both mandatory and voluntary exclusion grounds apply. The bidder must confirm that none of the mandatory exclusion grounds under Section 95(1) of the Public Procurement Act apply to it, including convictions related to participation in a criminal organisation, corruption, fraud, terrorism, money laundering, breaches of employment conditions, illegal use of child labour or human trafficking, tax debts, or sanctions violations. The bidder must also confirm that none of the voluntary exclusion grounds under Section 95(4) apply, such as serious or repeated breach of previous public contracts or submission of false information about qualification requirements. In addition, the bidder’s place of residence or establishment must not be in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 200,000 per year. To prove this, the bidder must submit an extract from the accounts for the last three completed financial years or another proof if the data are publicly available in a register. At least six months must have passed since the end of the last completed financial year by the deadline for submitting tenders. The tender must include Form 1, ‘Technical information - KP_KP oil transformer’, and all required fields must be completed. The bidder must provide the names and contact details of the person(s) signing the contract and the contact person for contract performance; if the right of representation does not arise from the articles of association, a power of attorney must be included. The tender must comply with the procurement documents, and where necessary, equivalent solutions must be supported by evidence. The bidder must confirm that it will use the buyer’s EPP portal for issuing sales invoices. As regards payment terms, the bidder must choose the buyer’s standard payment term; if the bidder joins the factoring programme, a 95-calendar-day payment term applies.
