Compliance requirements
The bidder must confirm that neither it nor any entity whose resources it relies on for qualification has any exclusion grounds under Section 95(1) of the Public Procurement Act. If the answer is no, the bidder must describe which exclusion grounds apply. In addition, entities whose place of residence or establishment is in the Russian Federation or the Republic of Belarus are not allowed to participate; this also applies to any entity whose qualifications the bidder relies on.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last two completed financial years must have been at least EUR 100,000; assuming the financial year follows the calendar year, these are 2025 and 2024. The bidder must submit Form 1 with the data needed to verify its qualification. The bidder must have at least one properly performed similar construction contract completed within the 60 months before the publication date of the contract notice. A similar contract must have been performed as a main contractor or contractor and must have involved the construction, extension or full-scale reconstruction of a building, part of a building or a building complex, including at least the installation of a new electrical system. The bidder must provide the contract data, and if requested, a confirmation letter from the client, as well as Form 1. To carry out the works, the bidder must involve a project manager who has either a level 6 construction engineer certificate in the sub-speciality of building construction and the occupation of construction management, or a level 6 construction manager certificate with the full specialisation in general construction, or an equivalent qualification. If the certificate was issued in Estonia, the contracting authority will verify the qualification through the public professional register; if it was issued abroad, the bidder must submit a copy of the qualification document and a confirmation from the competent Estonian authority that the foreign qualification corresponds to the required qualification. The bidder must also submit Form 4 for all specialists involved. The tender must comply with the procurement documents, and any equivalence must be explained and supported by evidence where necessary. In the case of a joint bid, Form 8 must be submitted together with the power of attorney and the joint and several liability confirmation. The bid price must be submitted in euros in Form 3 and in the eRHR worksheet; if the amounts differ, the amount calculated under Form 3 prevails. The bidder must also submit Form 2 and a list of documents protected as business secrets.
