Compliance requirements
The bidder must confirm that neither the bidder nor its management, administrative or supervisory body members, procurators or other authorised representatives have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or terrorist offences related to the commission of a terrorist act or terrorist activity. If any such ground applies, information on self-cleaning or measures to restore reliability must also be provided where allowed. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 50,000 excluding VAT. Joint bidders may aggregate turnover. If the bidder relies on another entity’s resources, the bidder must also provide that entity’s details and, where required, its consent and evidence of turnover.
To demonstrate technical and professional capacity, the bidder must submit a list of public road construction contracts completed within the 60 months preceding the start of the procurement. The contracting authority may request confirmations from the client that, under those contracts, interior alteration, repair or reconstruction works were carried out in office or administrative buildings, including construction, finishing, electrical and technical system adjustment works, and that the contracts were performed properly. If the bidder relies on another entity’s capabilities, the bidder must also provide that entity’s details and, where required, its consent and confirmation of direct participation in contract performance.
To ensure compliance of the tender, the bidder must confirm acceptance of all conditions set out in the contract notice and procurement documents, submit a tender only for the matters for which the contracting authority requested competing tenders, complete all price item fields in the HD IV price breakdown and submit it as an Excel file. The bidder must take into account all costs of materials, equipment and execution necessary until full completion and handover of the works. If the tender contains trade secrets, they must be marked and justified separately. In the case of a joint tender, a power of attorney for the joint representative must be submitted. For authorised persons, the bidder must provide the name and personal identification code, or confirm that no such persons exist.
