Compliance requirements
The bidder must confirm that neither it nor the members of its management, supervisory or controlling bodies have been convicted within the last five years of participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, or terrorist offences. If any such ground applies, information on self-cleaning measures to restore reliability must also be provided, where permitted. The tender documents also require a confirmation that the bidder will not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register or another relevant register in its country of establishment and, upon the contracting authority’s request, provide a copy or printout proving the registration. For construction works, the bidder must have completed, as main contractor within the 60 months preceding the start of the procurement, at least 1 contract under which it carried out construction works for at least one building with a closed net floor area of at least 500 m2. Similar works are building erection, extension or reconstruction in the categories of accommodation and catering buildings, office buildings, or industrial and warehouse buildings. The tender documents also require confirmations of bid compliance, a power of attorney for joint bidders, disclosure of trade secrets, and submission of the bid price in the prescribed structure. The machine-readable notice did not include precise other qualification or compliance requirements; these must be checked in the tender documents.
